Agreement to Terms

By accessing or using the Deenya mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App. We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

Description of Service

Deenya provides AI-powered fitness coaching services, including personalized workout plans, nutrition tracking, progress analytics, and related features. Our services are designed to support your fitness goals but are not a substitute for professional medical advice, diagnosis, or treatment.

User Accounts

To use Deenya, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password secure and confidential
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. Users under 18 should have parental consent.

User Responsibilities

You agree not to:

Use the App for any illegal or unauthorized purpose
Violate any laws in your jurisdiction
Infringe upon the rights of others
Transmit any harmful code, viruses, or malicious software
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the App's functionality
Use automated systems to access the App without permission
Share your account credentials with others

Health and Safety Disclaimer

Important Health Notice

Deenya is a fitness coaching tool and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Always consult with a qualified healthcare professional before starting any new exercise or nutrition program, especially if you have any pre-existing health conditions.

You assume all risks associated with using our fitness recommendations. We are not liable for any injuries, health issues, or adverse effects that may result from following our workout plans or nutrition guidance.

Subscriptions and Payments

Subscription Plans

Deenya offers various subscription plans with different features and pricing. Subscription fees are billed in advance on a recurring basis (monthly or annually) and are non-refundable except as required by law.

Payment Processing

Payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred. You are responsible for maintaining valid payment information.

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage your subscription and turn off auto-renewal through your account settings or the App Store/Google Play Store.

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period, and you will retain access to premium features until that date. No refunds will be provided for partial subscription periods.

Free Trials

We may offer free trial periods for new users. If you do not cancel before the trial ends, you will be automatically charged for a subscription. You can cancel during the trial period without being charged.

Refund Policy

All subscription fees are non-refundable except as required by applicable law or as explicitly stated in these Terms. If you believe you were charged in error, please contact our support team within 7 days of the charge. Refund requests are evaluated on a case-by-case basis.

Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, images, videos, software, and AI algorithms, are owned by Deenya and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

User Content

You retain ownership of any content you submit to the App (such as progress photos or workout logs). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing and improving our services.

Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease, and we may delete your account data in accordance with our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, Deenya and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the App. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, secure, or error-free. We make no warranties regarding the accuracy, reliability, or completeness of any content or recommendations provided through the App.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Deenya operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of that jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or via email. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.
